Mid-West and other broadcasters filed for a one-year extension so the FCC could reconsider the requirement that the license for the original station be returned (link below). Other than taking delivery of the petition, I don't think the FCC has done ANYTHING about this since then.
It's really galling to see companies like Mid-West game the system when the other broadcasters played by the rules and returned the licenses for the original stations their new expanded band stations were built to replace. But it's not exactly news that the FCC is toothless. Hand out $10K fines for the ticky-tacky shit, but don't sweat the big stuff.
